In the 1990s, judges and scholars used the expression “law of the horse” in debating whether cyberlaw should be treated as a niche area of the law, or whether general legal principles were sufficient to address issues arising in cyberspace. Since that time, cyberlaw has developed into a unique segment of the law that continues to evolve in response to emerging technologies.
The Asian Pacific American Bar Association of Indiana (APABA-IN) invites you to celebrate the Year of the Horse with a cyberlaw program featuring an impressive lineup of presenters, including two former U.S. Attorneys for the Southern District of Indiana and a former Justice of the Indiana Supreme Court.
Cybersecurity and Data Privacy
- Zachary A. Myers of McCarter & English LLP, former U.S. Attorney for the Southern District of Indiana, will provide an update on cybersecurity and data privacy laws, including issues related to cybercrime, ransomware, and data breach response.
Digital Asset and Emerging Technology Amendments to the UCC
- Professor Frank Sullivan, Jr. of Indiana University Robert H. McKinney School of Law, formerly an Indiana Supreme Court Justice, will discuss efforts and developments relating to the amendments to the UCC to address digital assets and other emerging technologies. Professor Sullivan was on the commission that worked on and approved these comprehensive amendments, designed to address emerging technologies like virtual currencies, blockchain, and AI.
Bitcoin and the Case of United States of America v. Pilipis
- Joshua Minkler of Barnes & Thornburg LLP, former U.S. Attorney for the Southern District of Indiana, will discuss his experience defending a bitcoin exchange operator in a federal criminal case that received national attention, United States v. Pilipis, Case No. 1:24-cr-00009-JMS-MKK, 2025 WL 486604 (S.D. Ind. Feb. 13, 2025). The issues involved the application of traditional money laundering statutes and definitions regarding “money” and “currency” to modern day cryptocurrency such as bitcoin.
